1. Introduction

These Donation Terms & Conditions (“Terms”) govern the use of the website https://vsigaskauskufondas.lt (the “Website”) and the making of donations through the Website.

The Website is operated by:

VšĮ RŪTOS IR DANO GAŠKAUSKŲ PARAMOS FONDAS
(“we”, “us”, “our”), a public institution (viešoji įstaiga) established under the laws of the Republic of Lithuania.

By using the Website or making a donation, you agree to be bound by these Terms. If you do not agree, please do not use the Website or make donations through it.


2. Purpose of the Fund and Use of Donations

Our non-profit organisation exists to support:

Unless explicitly stated otherwise in a particular campaign, donations are used to support the above purposes, including but not limited to:

  • medical expenses, rehabilitation, care and assistance;

  • home adaptation, special equipment, transport and accommodation needs related to treatment;

  • administrative and organisational costs necessary to raise funds and manage the Fund (e.g. bank fees, payment gateway fees, accounting, legal services, Website and IT costs).

We will use donations in good faith and as efficiently as possible to achieve the stated purposes. However, we reserve the right to reallocate funds between related needs (for example, between different medical or rehabilitation expenses), if this is necessary or more appropriate given the actual situation.


3. Making a Donation

3.1. Voluntary nature

All donations are made voluntarily. You are under no obligation to donate and you should only donate amounts you can afford.

3.2. Methods of donation

Donations can be made:

  • via the online forms on the Website (e.g. using GiveWP and integrated payment gateways);

  • by bank transfer to our official bank account(s), as stated on the Website;

  • by any other method clearly indicated on the Website from time to time.

3.3. Information you must provide

When making an online donation, you may be asked to provide:

  • your name and surname;

  • email address;

  • billing address (if required for accounting);

  • payment details (processed by payment providers);

  • any message or dedication you choose to include.

You must ensure that all information you provide is accurate and not misleading.

3.4. Minimum / maximum amounts

We may apply minimum or maximum donation amounts per transaction, as indicated in the donation form or by the payment provider.

3.5. Recurring donations

If you choose to create a recurring donation (e.g. monthly), you authorise us and/or our payment service provider to collect the specified amount at the chosen frequency until you cancel. You can usually cancel a recurring donation:

  • directly via your account with the payment provider (e.g. bank, PayPal), and/or

  • by contacting us using the contact details provided on the Website.

Please allow a reasonable time (e.g. a few working days) for cancellations to take effect.


4. Payment Processing and Fees

4.1. Third-party payment providers

Online payments are processed by third-party providers (such as banks, Stripe, PayPal or others listed in the donation form). We do not store your full card number or security code.

Your use of those payment services may be subject to their own terms and privacy policies. We encourage you to review them before donating.

4.2. Bank and gateway fees

We may incur bank charges, payment gateway fees or currency conversion fees related to your donation. Unless explicitly stated otherwise, these costs are deducted from the donation and covered from the funds received.


5. Confirmation, Receipts and Tax Treatment

5.1. Donation confirmation

After a successful online donation, you should receive an on-screen confirmation and/or email receipt to the email address you provided. If you do not receive confirmation within a reasonable time, please contact us.

5.2. Tax deductibility

The tax treatment of your donation depends on the law of your country of residence. These Terms do not constitute tax advice.

  • Donors in Lithuania and other countries should consult their own tax advisor or local rules to confirm whether and how their donation may be tax-deductible.

  • We may, where applicable, issue documents required by Lithuanian law to confirm the donation, but we cannot guarantee any specific tax benefit for you.


6. Refund Policy

Because donations are used to support urgent and ongoing needs, donations are generally non-refundable.

We may, at our discretion and in exceptional circumstances, consider a refund request – for example, in cases of:

  • technical error (e.g. duplicate transaction, obviously incorrect amount);

  • proven unauthorised payment (fraud).

Any refund will be made only to the same payment method / account from which the donation was originally received, where technically possible.

If you believe there has been an error, contact us as soon as possible with:

  • your name;

  • date and amount of donation;

  • payment method and reference;

  • explanation of the issue.


7. Transparency and Reporting

We aim to ensure transparency regarding the use of funds. Subject to personal data protection and confidentiality:

  • we may publish general information about donations received and how funds are used (e.g. reports, summaries, updates);

  • we may share more detailed financial information with relevant authorities, auditors and in accordance with Lithuanian law.

Individual donors are usually not listed by name publicly, unless:

  • you explicitly consent to such publication (e.g. if we ever offer “public donor list” option); or

  • the law requires otherwise.


8. User Responsibilities

When using the Website and making donations, you agree that you will not:

  • violate any applicable laws or regulations;

  • use the Website to commit fraud, money laundering or any other illegal activity;

  • attempt to interfere with the security or proper functioning of the Website;

  • submit false, misleading or defamatory information.

We reserve the right to refuse or return a donation and/or restrict access to the Website if we have reasonable grounds to suspect abuse, fraud or illegal activity.


9. Intellectual Property

Unless stated otherwise:

  • all content on the Website, including text, images, logos, graphics and design, is owned by us or used with permission;

  • you may view, download and print content only for your personal, non-commercial use and for the purpose of supporting the Fund;

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • we will not be liable for any indirect, incidental, special or consequential damages, including loss of profit, arising from or in connection with the use of the Website or donations made through it;

  • our total liability in respect of any claim related to the Website or a particular donation will be limited to the amount of that donation, unless mandatory law requires otherwise.

Nothing in these Terms limits or excludes our liability where it cannot be excluded under applicable law (for example, in cases of intent or gross negligence).


11. Personal Data and Privacy

Your use of the Website and donations are also governed by our Privacy Policy, which explains how we collect, use and protect your personal data.

By using the Website or making a donation, you acknowledge that you have had the opportunity to read the Privacy Policy.


12. Changes to These Terms

We may update these Terms from time to time, for example, to reflect changes in law, our activities or the Website’s functionality. The updated version will be published on the Website with a new “Last updated” date.

Your continued use of the Website or further donations after changes have been published will constitute your acceptance of the updated Terms.

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict of law rules.

Any disputes arising from or related to these Terms, the Website or donations shall be subject to the jurisdiction of the courts of the Republic of Lithuania, unless mandatory law provides otherwise.
